A patent is a governmental grant or license that bestows a right or title for a specified duration, particularly the exclusive right to prevent others from producing, using, or selling an invention.

Process for patent registration in India:
  • *Initially, a Non-Disclosure Agreement (NDA) is signed between NexgenIPR Solutions and the Patent Applicant.
  • *Following the NDA, upon receiving invention details from the inventors, we typically conduct, though optionally, a Patentability search to determine the patentability of the device/process.
  • *Upon a positive search outcome, we prepare the Complete/Provisional Patent Application and file it at the Indian Patent Office.
  • *Once filed, the application is published after 18 months if no request for early publication is made. If such a request is filed, the patent application is published within one month.
  • *Following publication, we need to request examination.
  • *Upon request, we receive a first examination report from the Patent Office, to which we must reply to meet prosecution requirements. Once the examiner is satisfied with our response, a patent certificate is issued.

To file a Patent Application, we need details of the invention, along with drawings, diagrams, or sketches elucidating the invention's operation. These visuals should effectively demonstrate the functionality of the invention and are crucial components of the patent application.
